Important notice about your legal rights
These Terms contain a binding arbitration agreement and a waiver of your right to participate in a class action. Read section 16 carefully. It affects how any dispute between us is resolved. You have 30 days from your first order to opt out of arbitration, and section 16.6 explains how.
1. Who we are and what these Terms cover
This website and store are operated by Mantch Group LLC, a Wyoming limited liability company, trading as MOIS ("we", "us", "our"). Our registered address is 1309 Coffeen Ave STE 1200, Sheridan, WY 82801, United States.
These Terms govern your use of this website and any purchase you make from it. By browsing the site or placing an order you agree to them. If you do not agree, do not use the site.
Our Refund Policy, Subscription Policy, Shipping Policy and Privacy Policy are part of these Terms.
2. Eligibility
You must be at least 18 years old and able to form a binding contract. By ordering you confirm that you are, and that the information you give us is accurate.
3. Products, and what MOIS is not
MOIS is a dietary supplement. It is a food product, not a medicine.
These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure or prevent any disease.
Nothing on this website is medical advice, and nothing on it should be treated as a substitute for advice from a qualified healthcare professional. Consult your doctor before taking MOIS if you are pregnant or nursing, taking any medication, being treated for a medical condition, or under 18. Stop taking it and seek advice if you experience an adverse reaction.
Any research we reference is research on an ingredient, not a trial of this product, and is presented as background only. Individual results vary and we do not promise any specific outcome.
4. Product information and label accuracy
We work to describe products accurately, but we do not warrant that every description, image or other content is complete or error-free. Colours, packaging and label design may vary between production batches. Always read the label on the product you receive before use, and follow the serving directions there.
5. Pricing, and errors
Prices are in US dollars and may change without notice. We take care with pricing but errors happen. If a product is listed at an incorrect price, we may cancel the order and refund you in full, even after you have received an order confirmation. An order confirmation is an acknowledgement that we have received your order, not our acceptance of it.
6. Order acceptance
We may refuse, limit or cancel any order. This includes orders that appear to be for resale, orders with quantities we consider excessive, orders that fail address or payment verification, and orders from customers with a history of misuse of our refund policy. Where we cancel, we refund in full.
7. Subscriptions and automatic renewal
If you choose a subscription, you authorise us to charge your payment method automatically on the interval shown at checkout until you cancel. The full terms, including the cancellation deadline, price changes and refunds on renewal orders, are in our Subscription Policy, which forms part of these Terms.
8. Shipping, title and risk
Title and risk of loss pass to you on delivery to the address you supplied. Our Shipping Policy applies.
9. Refunds
Our Refund Policy applies. Returns are by approval only, and a return address is issued only after a return has been approved. Items sent to us without an approved return request are not eligible for a refund.
10. Authorised sales channel
MOIS is sold only through this website. We do not authorise resale on marketplaces or through third parties. We do not warrant, support or refund product bought anywhere other than here, and we cannot verify that such product is genuine or has been stored correctly.
11. Reviews and submissions
If you send us a review, photograph, comment or other material, you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, adapt and publish it in any medium, without payment or attribution. You confirm the material is yours to give, is accurate, and does not infringe anyone's rights or contain unlawful content. We may edit or remove any submission. We do not have to keep any submission confidential.
12. Prohibited uses
You may not use this site for any unlawful purpose, to interfere with its security or operation, to introduce malicious code, to scrape or harvest data, to impersonate any person, to submit false information, to infringe our intellectual property, or to resell our products without our written permission.
13. Intellectual property
All content on this site, including text, images, design, branding and the MOIS name, is owned by us or licensed to us and is protected by intellectual property law. You may not copy, reproduce or use it commercially without our written permission.
14. Disclaimer of warranties
To the fullest extent permitted by law, the site and the products are provided "as is" and "as available", without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure or error-free.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
15. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, arising out of or connected with your use of the site or the products, whether in contract, tort or otherwise, even if we have been advised of the possibility.
Our total liability to you for all claims arising out of or connected with these Terms, the site or any product, in aggregate, will not exceed the greater of (a) the total amount you paid us for the order giving rise to the claim, or (b) one hundred US dollars (US$100).
16. Dispute resolution and arbitration
16.1 Talk to us first. Before starting any formal proceeding, you agree to contact us at help@moishealth.com and give us 30 days to resolve the matter informally.
16.2 Binding arbitration. Any dispute, claim or controversy arising out of or relating to these Terms, the site or any product, that is not resolved informally, will be settled by binding individual arbitration administered in the United States under the rules of a recognised arbitration provider, rather than in court.
16.3 Class action waiver. You and we each agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims.
16.4 Jury trial waiver. You and we each waive any right to a trial by jury.
16.5 Small claims. Either of us may bring an individual claim in small claims court instead, if it qualifies.
16.6 Your right to opt out. You may opt out of this arbitration agreement by emailing help@moishealth.com with the subject line "Arbitration Opt-Out", within 30 days of your first order, stating your name, order number and that you are opting out. Opting out does not affect any other part of these Terms.
16.7 Time limit. Any claim must be brought within one year of the event giving rise to it, to the extent permitted by law.
17. Governing law and venue
These Terms and any dispute arising from them are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Where a matter is not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming.
18. Indemnification
You agree to indemnify and hold harmless Mantch Group LLC, its members, officers, employees and suppliers, from any claim, loss, liability, cost or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the site or a product, or your violation of any law or third-party right.
19. Electronic communications
By using the site or ordering, you consent to receive communications from us electronically, and you agree that electronic communications, agreements and notices satisfy any legal requirement that they be in writing.
20. Termination
We may suspend or terminate your access to the site, refuse future orders, or cancel any active subscription, at any time and without notice, where we reasonably believe you have breached these Terms.
21. Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including carrier failure, supply shortages, industrial action, extreme weather, or acts of government.
22. General
If any provision of these Terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may. These Terms, with the policies referenced in them, are the entire agreement between us and replace any prior understanding.
23. Changes to these Terms
We may update these Terms. The version published on this page when you place an order is the version that applies to that order. Continued use of the site after a change means you accept the updated Terms.
